Does Amazon allow products using NAC (N-Acetylcysteine) as an ingredient to be sold on Amazon?

Working on a beverage product that has NAC in it but I was not able to find any clear guidance from Amazon whether NAC is okay to use in a product as an ingredient. I see plenty of Amazon listings for raw NAC pills and supplements so I am assuming NAC is fine but how can I get a concrete answer?

I don't know the answer to your question (don't even know what NAC is), but I would warn against assuming that something is allowed because you see a lot of listings for it. Just look at all the people getting suspended for Nike products....

You're smart for wanting a concrete answer. Hopefully you'll get one.

It doesn't hurt to create a case and ask seller support. Look what they answer.

It seems to be OK in supplements, because I order them on Amazon.

EDIT: OK well apparently it's not OK based on other responses. I guess I'm going to place another order before I can't lol.

So, on the FDA page it says they are considering allowing it as a supplement since it was marketed as a drug first, but as of right now it is only a drug. All the listings that have that as an ingredient are technically illegal, according to the FDA's page on NAC products, because this has not been approved yet. I would definitely steer clear of investing time and money into selling this on Amazon.

2022: "FDA has determined that NAC is excluded from the dietary supplement definition under section 201(ff)(3)(B)(i) of the FD&C Act because NAC was approved as a new drug before it was marketed as a dietary supplement or as a food."

November 29, 2023: "Today, the FDA has added its systematic review of literature regarding N-acetyl-L-cysteine (NAC) to the Peer Review Agenda. The agency has completed its review of safety information related to NAC, which will now go through the peer review process as a next step. The FDA undertook this review as part of its evaluation of a citizen petition’s request for the agency to undertake rulemaking to provide that NAC is not excluded from the definition of “dietary supplement.”"

Hello @Seller_lDD0jLSfQL7QI,

Thanks for posting to the Forums. As your fellow sellers have stated, if NAC is an FDA approved drug there may be requirements related to these type of products, and they would fall under the dietary supplement policy.

Regards,

- Manny
