Foreign Chinese sellers jumping onto an ASIN only to ship out their copy own version of the listed product once orders are placed

Dear Amazon and fellow third-party sellers,

We want to ask if the situation we're in as Amazon's third-party seller is a "lost cause".

We've been running our Amazon FBA business for about 10 years.

As a U.S.-based business, we do our best to comply with applicable laws, Amazon's policies, and other ethical business practices.

Throughout the years, we've invested much money and time into building the best reputation possible for the brands that we carry on Amazon.

However, running FBA business on Amazon is getting harder and harder.

Specifically speaking, we have a listing (our main product) that we've been selling for numerous years as the listing creator and the sole seller of the ASIN.

The listing description clearly states the product's brand name and that is made-in-USA.

Recently, foreign Chinese sellers have jumped onto the listing.

But they're shipping out their own cheap, copy version of the product when customers place orders.

According to our test orders, most of these sellers' products are the same exact replica, made from the same factory in China.

Their brand name, packaging, and instruction sheets are all in Chinese writing with minimal English written here and there.

It also clearly states "Made in China" with a generic Chinese brand name.

In short, they are on the listing selling a totally different / imitation product than what's illustrated on Amazon's detail page.

We've counted 15+ sellers so far, and our experiences with them lead us to believe that this is intentional.

(2~5 sellers come in and out of the listing at a time)

Total avoidance and disregard to policies/regulations seem to be working fine for them.

We keep reporting this abuse to Amazon, but the sellers disappear for only about a week at best (many stay on the listing regardless), and then come back on the listing doing the exact same thing.

We've worked very hard for YEARS to maintain 4.5 start product rating.

Now, we're seeing product reviews such as "It was not the product described but a chinese made .. much cheaper" or pictures & reviews based on these copy products.

We're now making our test orders from multiple sellers on a daily basis, only to eventually have them come back on the listing (doing the same thing) about a week later.

We've drastically reduced our FBA inventory because we don't know where to go from here.

We're hesitant to invest more time and money to advertise and build our brands on Amazon.

We've completed Brand Registry with Amazon, but we can't even report them since the trademark is still in "pending" status.

And we're not even sure if Product Zero is even feasible.

(If possible, we would like to explore this option)

Can anyone give us some guidance on the matter?

We have THE SAME issue. Being brand registered, having pending trademark, having logo and brand name everywhere here isn-t helped.

I was told that I will have a priority as an authentic seller. But IT IS NOT TRUE. the Chinese sellers who's using our listing are just put the cheapest price and win buy box, because they are selling imitation of product and cheap quality fake product. While we are offering a custom and high quality offer to our valuable customers.

Shame on amazon policy that not protecting real sellers with good products... Really nobody cares.

We're facing the same EXACT issue that you have.

The worst thing is that most of these sellers don't even ship the product, and we spend 1 month waiting for our "test orders" to arrive, to no avail.

We're brand registered, trademark approved in Canada and trademark registered pending approval in the US.
