Intellectual Property Retraction Received. Amazon Refuses to Remove Violation
@Dougal_Amazon
I've read through the forums and I saw that you help people with intellectual property violations. I'm hoping you can assist me with a situation I'm currently facing.
I need help with responding to Amazon about an intellectual property violation that we received on our account. I reached out to Account Health twice and Seller Support and I am getting conflicting information.
Here's the situation:
There is a Patent Violation on my account that should have been removed several weeks ago and yet it is still there. I called seller support and they said that the violation would be removed after 2 days. That was over a month ago and the violation is still there, even though Amazon sent me an email saying a retraction for this violation was received. Here is the email that was sent to me:
Hello,
We received a retraction from the rights owner for the complaint below. As a result, we removed listing restrictions and the Account Health policy violation record for the following content:
ASIN: B0959DDVRK
Complaint ID: 15275315161 We apologize for any inconvenience this has caused.
What if my listing is still inactive? Please complete the steps below if your offer is inactive: 1. In the Inventory section of Seller Central, select Manage Inventory (https://sellercentral.amazon.com/inventory/).
2. Search for the offer in question, or select Fix Stranded Inventory. 3. Click Edit on the right of the inactive offer. 4. Click "Save and finish". Allow up to 10 to 15 minutes for the listing to be reinstated. If the ASIN or offer is not reinstated after completing the steps above, there may be additional reasons why these listings were deactivated. Review and resolve any remaining issues by visiting your Account Health page (https://sellercentral.amazon.com/performance/dashboard?reftag=email_reinstate), or you can select Account Health on the home screen of the Amazon Seller app on your iOS or Android device. The Account Health page shows how well your account is performing against the performance metrics and policies required to sell on Amazon. We’re here to help. If you have questions about managing your inventory, visit Seller Central (https://sellercentral.amazon.com/gp/help/201186860) or contact us (https://sellercentral.amazon.com/cu/contact-us).
Thank you, Amazon.com Sincerely, Amazon.com

Here is the email I originally received acknowledging the violation:
Hello,
We removed the listings below.
ASIN: B01BCVMCHO, B08MBXDX1B, B0C73V92P5, B0CFJJ3233, B08ZMZLGP1, B00439T92O, B0BMKB3NMK, B0CHW4PJD5, B00G9PYTFM, B0959DDVRK, B0CHS3ZTKY, B0CHYV22PP, B00FE2RZDY, B08FCVXW4P, B0CM5NSFFQ, B0BRYJ39LX
Infringement type: Utility Patent
IP asserted: 8,926,331
Complaint ID: 15270803181
Rights owner name: Joseph R. Sozzani, Esq.
Why did this happen?
We removed some of your listings because we received a report from a rights owner alleging they may infringe upon their patent. This is against Amazon policies. Sellers on Amazon must comply with Amazon listing policies and are not allowed to sell products violating Amazon policies (https://sellercentral.amazon.com/gp/help/external/201361070).
How do I reactivate my listings?
To reactivate your listings, please send any of the documents listed below for us to review:
-- A court order stating you are allowed to sell the products and hence are not violating Amazon policy for each of the listings mentioned in the deactivation notification.
-- A letter of non-infringement from legal counsel.
-- Work directly with the rights owner who reported the violation to submit a retraction. We may only accept retractions that the rights owner submits to us directly. We do not accept forwarded or attached retractions. These are the rights owner’s contact details:
-- Rights owner name: Joseph R. Sozzani, Esq.
-- Rights owner email:
Have your listings been removed in error?
If you believe there has been an error, please submit an explanation. Your explanation should include the following information:
-- How the removed listings have not violated the Amazon Intellectual Property Policy.
-- Evidence that shows the removed listings have complied with the Amazon Intellectual Property Policy.
How do I send the required information?
Go to Received Intellectual Property Complaints in the Product Policy Compliance section on Account Health (https://sellercentral.amazon.com/performance/dashboard?ref=ah_em_mpa). Locate the deactivation record for the listings you want to appeal and click on the Appeal button next to the record to submit your appeal to reactivate your listings.
What happens if I do not send the requested information?
If we do not receive a response, the listings will remain removed and the violation record will remain on your Account Health page for up to 180 days after the notification or until the violation is addressed. Leaving this or other policy violations unaddressed may result in account deactivation.
We’re here to help.
If you need help understanding why your listings may infringe the intellectual property rights of others, search for “Intellectual Property Policy” in Seller Central Help (https://sellercentral.amazon.com/gp/help/external/201361070). You may contact us for more information if required (https://sellercentral.amazon.com/cu/contact-us)

Greetings Shopping_Spree_Bouti,
I apologize for the delay in responding to you here at the Seller Forums. Our team of moderators are constantly working to address all inquiries as soon as we can.
Thank you for providing such detailed information about your issue. Having this level of context is extremely helpful, as it allows us to better identify and address the problem you are facing.
I have reached out to the responsible team, and they have informed me that there is still one ASIN present on your dashboard. However, upon carefully reviewing the retraction documentation, the product with ASIN B01BCVMCHO was not included in the most recent submission.
To ensure we have a comprehensive understanding of the situation, could you please let us know if a separate retraction was also sent for this specific item?
Please note that the retraction must come directly from the rights owner, and screenshots will not be considered valid.
Thank you for contacting us! The forums community and I are committed to assisting you. Feel free to share how we can support you moving forward.
I wish you all the best,
-Nikki
