Copyright Infringement - Packaging

I've discovered that a seller has not only copied my product but also the packaging.

Copycat seller has copied - The back artwork of my packaging - almost exactly - words and artwork.

How do I report this? I tried using the report infringement on brand registry but it says I have to post a URL to show what is being copyrighted.

The copycat seller - does not post images of their packaging (for obvious reasons).

The report infringement tool does not allow you to upload images.

My name is Dougal from the Community Manager Team and I would be happy to assist with reporting potential copyright infringement.

Since you mentioned reporting the infringement on Brand Registry I am assuming you are enrolled and have access to the report a violation tool, awesome. The proper process to report this is outlined in the Intellectual Property for Rights Owners help page. Admittedly, this help page is very robust so I recommend reviewing the "B Copyright," section under "Main types of IP," for what can be reported and an example. Then scroll down to the "Reporting Infringement," section for instructions and best practices. Please also note that you do not have to supply a URL of your copyrighted work, you can provide with the copyright registration number or even a description of the work to include with your submission.

Having reviewed a number of these in the past, I also recommend keeping it simple and sticking to only the facts of how this product, image, packaging etc. is violating your Copyright.

Unless you registered your package wording or parts of it as a trademark with USPTO and / or you have a design patent for your package there is nothing you can do.

Brand Registry is a trap. Hijacker's live in brand registry. Amazon is the cause but not the cure. I hope there is a solution that does not break you.
