It is a real law firm. Are you selling a branded/trademarked product that you do not have proper authorization to re-sell?

You should zero out your inventory for whatever Brand they are claiming to represent and stop selling it immediately.

A lot of brands do not want 3rd party sellers selling their items.

If you do not stop selling the brand, they will more than likely pursue legal action against you.

Yep, be aware that they may have sent copies of this to amazon as well who will confiscate your merchandise and money. You may also be liable for criminal charges if this medical equipment requires a prescription to get like the letter alleges.

When in doubt, Google. If it is a legit law office it will come up on google within seconds. Same with the name of the lawyer. I would definitely get yourself a lawyer if I were you. I wish you the best of luck.

Call for warranty service on that product that you sell. Explain that you purchased it on Amazon from (your seller name). If they say "sorry, we don't recognize that retailer and the warranty is not valid", you have your answer.

If this is the case, you should heed this friendly notification.

I really wonder sometimes. This should take 5 minutes to figure out. First, you know whether you are doing some scheming or not. Did you purchase your products through a legit wholesaler? Or are these counterfeits? RA? Dropshipping? You dont have to say it here, but you obviously know the truth about where you sourced your products. Second, assuming you are using a legit source, which is unlikely, but assuming nevertheless, you should know about the brand they are referring to, and whether you are authorized to sell. Basically, you know way more than we do about this issue, so why are you asking us?

Remove all the items you are selling without permission and the contact the lawyer within 24 hours of removing your listings letting the lawyer know you complied.

You will be sued if you do not comply.

We are do wholesale and do over 4M per year. I've gotten 10 or more of these for various brands over the years. I've never been sued or even close to it. Do not destroy your inventory or overreact. Its really not a big deal at all. They actually have no real case in the end because of the first sale doctrine. They may say otherwise but it's nonsense. Just sell through what you have and don't restock. You can even let them know if you want. I typically tell them I plan to do that and they have no issue with it. Other sellers trying to scare you is silly. It's apart of that business model and you shouldn't freak out. They are just trying to get control of the listings and this is a tactic to run some folks off. Now if you stick around for years on end and cause damage to the brand they may take action.

This just happened to us two months ago for using a trademarked four sentence title in a listing we had!, We had to pay a settlement and our funds were held for two months. It was horrible, you're lucky they are being friendly. I would remove this merchandise and keep records of the disposal, the law firm already has how many you have sold and revenue dollars obtained from Amazon. If you continue to sell, you will be sued.

Check trademark and copyright websites before you sell anything that you are not authorized to sell with written permission.
