Incorrect cosmetic product classification as restricted item

hi Our cosmetic skin care product is incorrectly classified as a restricted item and our listing was removed. We submitted a U.S. regulatory attorney’s legal memorandum that classified each ingredient and qualified them under cosmetics as per FDA guidelines. We have a letter from FDA confirming it is a GRAS product falling under Cosmetics and yet when we shared this in appeal same copy paste reply is given that we evaluated your appeal but your product are restricted items so we can not relist them. All the replies too come from persons with only one alphabet as their last name. Has anyone gone through this nightmare? Did you find any solutions? Any help will be welcome. We spent so much to build our storefront and to market it. All down the drain. All other compliance and Health rating is stellar yet all of a sudden out of the blue it was incorrectly flagged as restricted product.

If by chance you use the wording "lightening/brigthening the skin" that is not allowed and make the bots think that it contains a (for Amazon) forbidden ingredient.

That's just ONE idea, there could be another hundred reasons to classify your product as restricted. If it's fine for the FDA doesn't mean that it's fine for Amazon. Amazon has its own rules.

As you have mentioned, I understand that your products have been classified as a restricted item.

Per our cosmetics and skin and hair care policy, all sellers must comply with all federal, state and local law and make sure that the product complies with amazon policies. In this policy page, there is a compliance check list. Does your product meet the requirements?

When a product is flagged for a restricted item, it can be due to but not limited to key words in the product detail page or actual ingredients in the product. @Seller_rI7BZIczK8iAC has made good points in their response.

When addressing the violation, you will want to edit the listing and remove the key words and submit supporting documents such as but not limited to, testing documents or ingredients list.

The forums community and I are here to assist you. Please let us know if you have any additional questions or concerns from this point forward.

Best,

Cade
