I need help to write POA for Potential Trademark Text Misuse
Hi, I need support to reactivate my account. It was deactivated because potential trademark text misuse violation (grunt style). I'm aware that Amazon takes this violation seriously. I deleted all the text grunt style immediately after seeing alerts in my account health and it returned to healthy with no more alerts. But my account was deactivated in the next few days. I've sent 2 plan of action but they were refused.
Here is my plan of action and I wonder what should I need to provide to get Amazon approval.
" Deer Amazon Seller Performance Team,
I understand that Amazon takes violations of the intellectual property rights of brands or rights owners very seriously. I would like to share with you my Plan of Action to appeal my seller account’s suspension due to Potential Trademark Text Misuse.
What happened:
- I received Potential Trademark Text Misuse (GRUNT STYLE) notices from Amazon for ASIN: B0C89JDRQY, B0C89K6Y51, B0C89L2CDR, B0C89J1J11, B0C89HJLDZ, B0C89JCBYY, B0C89LZY1C, B0C89NBL1H, B0C89K81BV, B0C89K1DZJ.
- I checked for IP and brand rights before selling the ASINs on Amazon but I missed the bullet points. I was not fully aware of Amazon’s Intellectual Property policies and guidelines. I have a loose workflow process leading to errors in trademark violation of the policy.
- I deleted all the potentially misused trademark text in bullet points but Amazon deactivated my account and deleted all my inventory products in the next few days.
- I believe this happened because I used the brand keyword in my bullet point. I thought it was just the style name of my product design which is Viking-style shirts.
What I have done to correct this problem:
- I took ownership of the violation and I immediately removed all the text “grunt style” in my bullet point listing when I received notices.
- I contacted Amazon Selling Partner Support on 17th June, and they said that “Please ignore listing alerts in case necessary actions have been taken”.
- My account health returned to a healthy rating of 212 points as usual without the “ Suspected Intellectual Property Violations ” alert after I took action.
- I have carefully reviewed all my bullet points content to make sure it is clear and fully compliant with Amazon policies and guidelines.
What I will do to prevent similar complaints in the future:
- To avoid future Intellectual Property Violations, I will consistently stay updated on Amazon's guidelines and policies at https://sellercentral.amazon.com/help/hub/reference/201361070. I will also actively monitor any policy changes or relevant laws that may impact me or my account, and promptly inform my team about them. I have to have permission from the copyright owner if I want to sell their product. I can’t use trademark text/ symbol/ design in my product or listing if it wasn’t genuine.
- I will check Product Detail Page Rules guidelines to make sure the listing file is fully compliant with Amazon at https://sellercentral.amazon.com/help/hub/reference/G200390640
- I will enhance my workflow by setting a checklist about IP policies to make sure my team checks every process before listing any product. The workflow includes:
Trademark/ Copyright research
My Right and Permission Check
Ensure Amazon IP policies
Ensure Product Detail Page Rules
Insert keyword appropriately to title/ bullet point/ product description.
- Before listing any new products on Amazon, I will verify that the products or listings don’t violate anyone’s intellectual property, trademark, copyright, or patent by going to websites “uspto.gov” and “trademarkia.com” to look up the trademark database. I’ll search every keyword on Amazon’s search to see if it was branded or not. Then, I’ll check right and permission to make sure if I can use it or not. I’ll reassure my listing with Amazon IP policies. I would also consult lawyer service in the last step for multiple listing files before uploading.
I believe that this plan of action adequately addresses the issue. This is my first time making a mistake. I hope Amazon will reactivate my selling privilege. I promise to never violate Amazon's policies again.
Sincerely, VTNL store"
