Section 3 POA

Hello there,

My seller account was deactivated for section 3 violation.

I have written the POA bellow and my account remained deactivated. If you could please help and let me know what’s missing:

Dear Amazon Seller Performance Team,

I am writing to address the deactivation of my seller account due to a Section 3 violation. I value my partnership with Amazon and have taken time to thoroughly investigate the issue, take corrective actions, and implement preventative measures.

Root Cause Analysis

After carefully reviewing the situation, I have identified the following:

I listed my product, “Turmeric Kojic Acid Cleansing Pads,” under an existing listing that did not explicitly mention a brand name in the title, description, or listing details.

The product I purchased has no visible brand name, and I sourced it from a verified supplier. I had no intention of selling branded products without proper authorization.

Upon further review, I discovered that the listing included product images displaying a brand name, which was not apparent when I selected it. This discrepancy led to a misunderstanding and subsequently to a policy violation when Amazon requested a brand authorization letter.

Immediate Actions Taken

To address the issue, I have already taken the following steps:

Product Removal and Destruction: I immediately created a removal order to destroy the inventory associated with the non-compliant listing.

Delisted the Product: I promptly removed my product from the misleading listing.

Reviewed Policies: I conducted a thorough review of Amazon’s policies regarding branded and generic product listings to ensure full compliance moving forward.

Preventative Measures

To prevent such issues in the future, I will implement the following measures:

Exclusive Focus on My Own Brand: Moving forward, I will no longer sell branded or generic products. I will exclusively focus on selling products under my own brand, ensuring I have complete control over compliance and brand representation.

Enhanced Supplier Verification: Although my inventory was sourced from a verified supplier, I will ensure that all future products are aligned with my own brand and meet Amazon’s guidelines.

Rigorous Listing Review Process: I will carefully inspect all aspects of existing listings, including images, titles, and descriptions, to ensure they are accurate and compliant with Amazon’s policies.

Seller Training: I will complete comprehensive training on Amazon’s policies, particularly those related to intellectual property and brand compliance.

Consult Amazon Support: In cases of uncertainty, I will consult Amazon Seller Support for guidance before listing any product.

Request for Reinstatement

I respectfully request the reinstatement of my seller account. I have taken immediate corrective actions, including the removal and destruction of the non-compliant inventory, and I am committed to adhering to Amazon’s policies. I will now exclusively sell products under my own brand to ensure full compliance.

Thank you for your understanding and consideration of my appeal. I am dedicated to maintaining a positive customer experience while fully complying with Amazon’s policies.
