Another seller is selling counterfeit product at low prices under our listing

Recently we found another seller selling at a low price under our listing, so we made a test purchase and the product we received was completely different. Although we have registered the brand on Amazon but I think it may be because our trademark is in pending status and we cannot complain through Amazon's "Report a violation".

what should we do? Please advise

go to the seller's detail and find out where they are from. Once you get that information contact them on all channels. get a cease and desist letter from an attorney or make one urself dosent really matter. Most likely you can scare them via Legal action. remaining comes down to where the seller is actually from. you can find services in almost all countries to help you in this regard.

Since you received a completely different item than the listing, you can Report Abuse of Amazon policies via the Account Health Dashboard and use the "The product received is different than the product on the detail page (different version, model or product)," report.

yep. we are on year 2 of the exact same issue. counterfit sellers making dupes of our products and selling from china. all you can do is report the infringment on the selling page.

typically it takes 2 to 4 weeks to resolve. and brand central does nothing except try to push you to a different department.

but none of resolves the issue that the ASIN and brand are supsoed to be locked. but arent

I have 15+ sellers all from China, all just launched or with 0% positive reviews, selling on my top four listings at cheap prices with long shipping times, while they launch new look alike product listings. All in past 10 days, after 10 years of selling. They all showed up at once. I've reported them on the listing. Nothing is happening so far.

Do I really have to buy from all sellersto prove its wrong brand? That could get expensive. Some units are $70-80.

Some sellers have reviews they never shipped items. How long do I have to wait before I can say they never shipped? [Not to mention how are they still selling?]

I reported to brand registry who said to report on Seller Support who told me to report on Brand Registry.

I'm the brand agent in US and brand registry is in UK....they are now working on US Trademark, but I'm not sure that will help. It seems there is nothing I can do myself besides reporting on listing???

With brand registry can the brand remove sellers?

Go to their listing and click "REPORT ITEM". You don't even have to hold the trademark. It will shut them down for a minimum 24 hours while they fight it. I know this because I had someone do this to me with a false claim. Of course, if they are unable to establish that they are selling the genuine item, it should be lights out for that listing.

Take pictures of the item you received. Screenshots of the other sellers listing, seller name, etc.

I would try to report them through Brand Registry anyway providing the test buy order ID, screenshots, etc.

Or message seller telling them they do not have your permission to sell your brand and to remove it to avoid trademark/IP violations, sometimes that works.

AMAZON will not help you unless your health points are 350-1000 ...

the best you can do is file a DMCA take down with the USPTO but that will also mean you can not sell it on Amazon either...

amazon will favor the Chinese counterfeiter if they have a higher health points...
