I am confused. We submitted a complaint about someone using our trademarked name in their listing to sell their product. It came back as approved, and the listing was taken down. The very next day we submitted another complaint on the other 59 listings they had doing the very same thing. Everything was exactly the same but the asin number. Same situation, same back story. Our second complaint was rejected. Please help me understand. Either it is against Amazon policy to use someone else's intellectual property or its not. This doesn't make any kind of sense to me. I even had someone from amazon tell me it was legit in another discussion. How can you protect yourself when this goes on?

This was against the rules and the source of your ACTUAL drama. The other sellers with all their rights and duties listed on this generic listing.
This is very good, at least you didn't break the rules again by trying to CHANGE the title of the existing generic listing in order to keep ratings and reviews.
YOU created the monster and it will be difficult to kill it.
Nobody can hijack a generic listing. On the contrary, any seller selling an identic product WITHOUT brand MUST list on your generic listing.
In spite of all these irregulations you commited my advice is: since it was probably YOU that created these "generic" listings - and in consequence you are the owner of the related UPC from GS1 - you must have the rights to modify the listings. So try to list one of the ASINS again and try to modify the title by removing your brand name. The other sellers certainly try the same thing, but the system does not let them remove this brand from the title. I bet they also want to get rid of this uncorrect brand name in the title. They risk returns and closing of the listing if the customer complains about not having received the correct brand.

As @Seller_rI7BZIczK8iAC mentioned above, things can be a bit trickier assuming these sellers are selling under a Generic listing as those are "unbranded" products. If you provide the ASINs in question I would be more than happy to take a look into it!
