Counterfeit without test buy

Hello

This is the first time we have come on to the forum , hopefully someone will be able to answer our issue.

We have received a counterfeit with test buy policy violation on GripIt products from apparently brand owners, but we have tried contact via email and phone ( constantly busy line) the people who are making a false accusations but no reply from them, we have asked our suppliers to send us a letter of authorisation for us to sell the particular product. We are just worried that our account now in risk of deactivation with these 2 policy violations we do not sell any counterfeit goods all of our products are from genuine UK wholesaler/distributors.

What can we do to possibly to remove that violation. See below the message from Amazon.

Rights owner communication: We are the manufacturers and brand owners. We have not authorised anyone else to distribute our products, we are the sole supplier and have control of all authentic stock. Therefore as we have control of all authentic stock and we are unable to verify the authenticity of the Gripit item sold by these sellers, in the interest of protecting our brand and customers, we are requesting immediate removal of these offers. The brand owner is abusing brand registry to remove sellers they do not want selling their product at will.

I only see you as having two options.

1. Try sending an invoice to Amazon to see if they accept your invoice.

2. Try to reach out to the brand again and ask them to retract the complaint as long as you never sell the product again.

If none of these options work, there is no other alternative. The trademark infringement claim will remain on your account.

I have one of these and the same thing, Amazon accept the accusation and supply a contact email, however the entity making the accusation never reply, never engage and despite sending every piece of evidence it is still not accepted and this includes, invoices, images and barcodes.

The entity taking the case just ignores the emails and knows that Amazon will do nothing, there is no proof of their accusation and Amazon just accepts their word that the seller is selling counterfeit goods.

The fact that Amazon refuse to do anything when the entity making the accusation refuses to engage with the seller in any way is wrong.

I am taking legal action in my case and we hope to have the case in court in January and then we will see what happens.

Amazon have a responsibility to sellers as well and believing a company that has no evidence and refuses to engage is very disingenuous to the seller.

Before you ask, I supplied my supplier invoice, their invoice from the manufacturer and the actual images of the products containing the part numbers and barcodes, there was ZERO evidence that there was any wrongdoing or that the products were not genuine.

As the other poster said here, it is probably an abuse of the system to get rid of competitors and Amazon are unaware of the practice.

Three pieces of advice.

When looking to list a new product send the ASIN to amazon and let them tell you whether it is a Private label or not, it may take time but you wont have this issue again.

When on amazon check how may sellers are on the listing selling the same product.

Get you you SellerAmp SAS Account. It works if you work it.
