How did a brand get amazon listing approval on a product without using their logo or trademark anywhere on it the product
So i finally decided on a product and manufacturer after months of searching for a product/subcategory for my private label and was going to brand register my name. However, after further digging I found the exact product i was going to list. It was a store selling multiple categories. One of the categories (the category I'm choosing) had a couple of products from diff subcategories (one of which was mine). In one of subcategories , one product clearly showed the brand name on the product, however, for the subcategory that I wanted, the products did not have their brand name on any of the products that I wanted to list. When i looked up the ASIN it showed that I need approval to sell in this brand.
I thought Amazon will not let you list any product without your logo/trademark name on it? I read somewhere in this forum that if you have one product listed with your logo on it then you can sell any generic product even in a diff subcategory and use your brand to list it and it's automatically protected. Is this true? Also this store was selling this products at a highly discounted price compared to it's competitors. Some of it's variations had the logo "overstock' and even with the very low price it was barely selling this product. Are they violating Amazon compliance? Does this mean if I want to sell this, which I would do this produtct justice that I need to update the design and modify so i don't infringe on design?

1) do you already have a USPTO for your 'mark'?
2) If your items have the same mark/logo and you have your USPTO and then you register for Brand w/this platform
3) What others sell and at what price is now no longer your concern - you are offering your Brand and the reasons buyers should buy your item(s) - and that is why you cannot sell their Brand and they cannot sell yours either. = Unfortunately this platform will undermine you by showing other 'similar' items.
4) suggest you NOT put all your eggs in this basket and have your own site and look around for other venues to offer your Brand item(s)

The answer is really quite simple. Twenty years ago you didn't need any approval or UPC's You just made it up as you listed your product. Now fast forward to today, you need an approval and GS1 UPC's. Most likely the ones you see are simply grandfathered in. After selling continuously with no problems for years, Amazon is not dropping them.
