Wrong Brand Name on Products

Hi,

we had a case open but Support closed it: ID 16811122961

We are the brand owner of MIRADA, but someone listed our products (incl. EAN) mistakenly under a different Brand name, we provided all evidences, catalogue, website, etc. But still they claim change of the brand name will be misleading, while currently the product listings are advertised with a WRONG Brand Name.

Below the ASINs (incl. pictures showing clearly the correct brand name:

-ASIN B07SRT13VB, EAN 6291107920641

-ASIN B08KGGKNQX, EAN 6291107921419

-ASIN B07STVKCHD, EAN 6291107920214

As can be seen on the manufacturer website, these are products belong to the MIRADA brand (not EMPER).

How can this be resolved?

According to the USPTO, are YOU really the owner of this brand?

1) First off, they didn't mistakenly list as their brand, it was on purpose. If you look at their line of products, they have done this to a number of brands.

2) Have you registered your brand with Amazon? To get Amazon to do anything, you need to register your brand.

I assume you have a letter of attestation from the manufacturer that you are the brand owner for amazon purposes.

Unless a moderator here kindly responds with anything further, the best you can do is persevere with cases through seller support.

We have also had similar issues with brand registration and other brands tied to our products. No matter what evidence we supply to seller support the answer always starts with a change will be misleading to customers, when directly the opposite is actually the case. We have had just to persevere and, eventually, after many months, we've had our brands corrected.

I know it shouldn't be like that and I do hope someone else can offer a better solution.

Is it the case that a pop-up shop is cloning your best seller and driving your customers to their url, the customers unknowingly buying off of the cloned shop while believing it was yours? This happened to me this past weekend. These shops leech on to individual best selling products, I noticed that some of these products had up to 3 cloned shops attached to it. These shops also fake purchased my best unit, putting my inventory as sold out, forcing customers to their cloned product. I delisted my product for a day, but it killed my products momentum, and relisted it the next day. I made about 8 violation reports to Amazon support. My inventory is back and they seemed to have got off of my product. For how long will it work and how many customers did they sell to, I'm not sure.

When you report Amazons retarded answer likely is only the Brand owner can fix this =platform is so lame no clue why it hasn't crumbled yet guess people are just stupid.

It's really simple. You need to proove TWO things:

1. Go to the website of the USPTO. Put the brand MIRADA in the search. Make a screenshot of that result showing that the owner - according to the USPTO - is YOU, exactly how you are registered in your seller account in "Legal Entity".

2. Find the UPC code (GTIN) on that product. Go to the website of GS1. Put this code in the search. Make a screenshot of that result showing that the owner - according to GS1 - is YOU, exactly how you are registered in your seller account in "Legal Entity".

These proofs show that you are right: that YOU are the owner of this brand and of this UPC used for creating that listing.

If any to these is missing that means open doors for hijackers.

We are not listed in USPTO, but in the United Arab Emirates, correctly as MIRADA.
