Brand Registry Declined. Help!

Hello everyone, so I recently established an additional brand called OMINT, specifically to offer our products through Amazon. As part of this process, I submitted our business and product information—including our trademark—for Amazon Brand Registry.

Shortly after submission, I received the following notification:

“We are unable to approve your Brand Registry application for OMINT because: The trademark application submitted is identical or nearly identical to a brand already enrolled in Amazon’s store. To protect the shopping experience of our customers, we are currently limiting the number of brands with identical or highly similar names in our store.”

This was quite unexpected, as our attorney conducted a comprehensive trademark search prior to launching the business to ensure the brand name and logo were available and did not conflict with any existing marks. We are also unable to find any listings or registered brands using the name OMINT, nor any designs on similar products that would reasonably cause confusion.

I have reached out for support 2-3 times now, the first time I was sent the exact same denial notice again, which is what I needed clarification on and doesn't seem to make logical sense for the reasons I have laid out above. The second support request I received this in response, which I am essentially certain is not possible given the way we use amazon and conduct business:

"Hello from Amazon Brand Registry Support,

"I understand that you want to know about your declined brand registry application for the brand OMINT.

We've reviewed and found that applications can be declined under certain circumstances. This includes cases where we have reasons to believe that the to-be-added account has been involved in abusive conduct on our websites, or is related to an account that was used for such abusive conduct.

We have informed and provided a path for you to appeal via email."

We have gone to great lengths to comply with all of Amazon’s guidelines and the Brand Registry process, which we have successfully completed in the past without issue. Any clarity or direction other sellers or Amazon could provide here would be greatly appreciated.

I understand that decisions around Brand Registry applications may not be reversed, I want to make sure we fully understand the reason for these outcomes and what specific steps we can take to ensure a successful application upon appeal and resubmission.

I’ve attached our trademark (serial: 99242532) and an image of the product for your reference. If there is any other information you require just let me know. I am hoping you can connect me with someone knowledgeable regarding brand registry who can thoroughly investigate and explain these issues.

To further complicate things, I am now trying to follow the instructions Amazon Brand Registry support provided in their last email to "Appeal", but the option does not seem to exist. I am certain I have accurately followed these instructions.

If you want to appeal directly, follow these steps:

- To access, sign in to "Brand Registry".

- Go to the toolbar in the top and click "Manage".

- Select, "Brand applications".

- Locate the application you want to appeal, and click "Appeal".

I have checked in with the brand team on this case and situation.

Currently, to protect the buyer's shopping experience, brand is placing limits to brands with the same or highly similar names in the marketplace. I understand this is frustrating as you want to enroll your brand as soon as possible, however at this time this decision cannot be reversed and I cannot escalate to appeal.

Please reapply after your trademark has been fully registered with the trademark office. Thank you for your patience.
