RESELLER WITH EXPIRED PRODUCT, AMAZON NOT ADDRESSING THE ISSUE

Anyone have any suggestions for getting Amazon to address an issue of a reseller that is selling one of our products that is expired. Reseller has put a sticker over top of the location where all our products have a lot code and expiration date. This is topical skincare that should not be sold. We have made a test buy, sent photos, copies of letters from company executive citing this product is out of date. We have reported the abuse and Amazon keeps saying there is no violation? We are brand registered as well -- and this is damaging our reputation with customers who think they are buying from us! We don't want to delete the product and listing - we lose the sales data/history and risk the seller going rogue.

Have you looked into a whitelist for the brand since you are in BR?

I will have to guess given Amazon history and failure to address so many issues that @Jim_Amazonwill not be successful despite his best efforts.

It seems clear that Amazon is only allowing MAJOR brands to ‘whitelist’ which sellers are authorized.

It was suggested by one of the long term experienced sellers on a different forum that the following has worked successfully in the past.

Have your attorney send a carefully worded Demand Letter (by Certified Mail) to Amazon’s “Office of the General Counsel”.

I would think that you would want to include appropriate paperwork showing ownership of the TM from the USPTO, proof of registration in Brand Registry, and, any links to cases and messages that show that SO FAR Amazon has refused to protect your brand.

Basically, you need to put Amazon on notice that you expect the protections promised by Brand Registry.

This is RARE for a brand to phone up an alleged violator and negotiate. Do what all the Bullies do, lie in Amazon claims forms to get the seller removed.

If they are truly selling Expired items, then they would be purposely and maliciously trashing your trademark. So If this IS the case then trademark violation can be filed
