My brand application has been declined 28 times!

Hello everyone,

My brand application has been declined 28 times!

The first time said that the documentation we provided was incomplete or did not satisfy the requirements to confirm brand association or ownership.

Case ID: 11614191001

The second, third, and fourth times are the same reply, saying that there was a problem with my trademark's agent lawyer, but my lawyer is not aware of any issue. I have confirmed that my lawyer is a licensed US lawyer and has no negative records or penalties on the USPTO website.

Case ID:12250760851,12305305941,12409902461

The fifth time said that the brand/user has engaged in abusive conduct as per our policy. But our brand is new and has never been used, and our store is also new and has not yet started selling.

Case ID: 12737290641

And the sixth application is still pending review.

Case ID: 12779684601

I don't know what is wrong. My brand owner and the brand information are consistent with Amazon's store information. This is a new brand and never use it, we provide photos with our brand, Brand receipt, Invoice, Purchase Contract, Company Business License, etc. We don't know what additional information and documents we need to provide, We never received any calls from Amazon Team.

May we know what should I do next?

Please help. Thank you!

I have reviewed all the case IDs and have found that your denial of the Brand Registry application could be due to your attorney. Please see this past post I have made to another seller with a similar situation.

Working with an attorney or agent that violates United States Patent and Trademark Office (USPTO) rules and policies will prevent you from enrolling in Brand Registry or subject your Brand Registry to cancellation.

The USPTO rule requires foreign domicile applicants or registrants to be represented by a U.S. licensed attorney to improve the quality of trademark submissions. U.S. attorneys are required to follow the USPTO rules of professional conduct

and their state bar codes of conduct. Attorneys suspected of misconduct may be investigated by the USPTO.

If you’re working through an intermediary, rather than directly with a U.S. licensed attorney, to seek a U.S. trademark registration or enrollment into Brand Registry, your application may be subject to additional investigation by Amazon and the USPTO.


Before hiring an attorney or trademark service company, check whether they’re subject to an Order for Sanctions from the USPTO or listed on Potentially Misleading Solicitations.

If you’re concerned about the validity of your application or the conduct of involved parties, please consult with a private U.S. attorney to review your application.

At this time, I would recommend filing your trademark with a different attorney. Preferably one through the IP Accelerator so that you are able to work with vetted IP law firms.

Bro, are you trying to get your brand registry application completed and approved successfully this year or are you trying to be friends with your current lawyer? Cause it sounds to me like after say attempt #2 where you were told that there is an issue with your specific lawyer, the logical thing to do would have been to drop the lawyer and go through Amazon's Service Providers to find a new firm that you KNOW won't have any issues because there will be hundreds of reviews from other sellers who worked with the firm to get their brand registered through the IP accelerator, and put in a request for service! Within 3 business days you can have your whole application completed, submitted, and be about 14 days away from having your brand registered on Amazon. Or you can continue to do what you're doing and add as much "additional information" (what does that even mean??) as you believe you need, and still get rejected and then post another thread after attempt #56 asking why your application was rejected 56 times. It's really your choice in the end. Good luck.

Within 3 business days you can have your whole application completed, submitted, and be about 14 days away from having your brand registered on Amazon. Or you can continue to do what you're doing and add as much "additional information" (what does that even mean??) as you believe you need, and still get rejected and then post another thread after attempt #56 asking why your application was rejected 56 times. It's really your choice in the end. Good luck.
