Brand Registry "pending Amazon action"... Almost there!

I've been trying to register my brand every few weeks for the past 8 months now. Each time I get denied with something like this email (a list of 5-6 possible reasons):

  1. your account was engaging in conduct that violates Brand Registry’s policies, such as, but not limited to, invalid notice submissions through our notice submission channels or tampering with the catalog;
  2. your application or account is related to other Amazon accounts or brands that have violated Amazon or Brand Registry’s policies,
  3. you are associated with one or more selling accounts as a primary owner and all of them have failed seller verification,
  4. inability to provide sufficient evidence of branding on products/packaging;
  5. you have a selling account that is de-activated, or
  6. your trademark application appears to be filed by a filing firm that may be violating US federal regulations and USPTO rules

Fortunately, by posting in this forum, here. I received some very helpful clarity that my issue was due to #6, TM registration was registered with a bad filing firm.

I've resolved it, registered my TM with a new filing firm and we're off to the races!

I've resubmitted my case and I was denied because Amazon could not verify the registered business name and business identifier (e.g. tax ID number or business ID number).

I've appealed this and included my business ID number, tax number, and various supporting documentation.

However, the case has been "Pending Amazon Action" for weeks.

At this point my brand has had some traction off of Amazon and I don't want to risk selling here without the brand protection from Brand Registry, what's the best path here?

  • Create a new Amazon account and delete my old one, starting the process of from scratch?
  • Give up?

Any help would be greatly appreciated, here's to a successful business in 2024 all!

1. Amazon only offers sellers a platform to sell their brand on. Amazon does not tell you how to create a brand, Amazon expects you have already created a brand to sell on the site. Does your brand really exist in the real world before coming to Amazon to sell it, or are you trying to start a brand by using the Amazon Site. That is the difference, and it is easy for Amazon to tell.

If your brand product really exists in the real world, your products will meet all US standards for packaging (child safety warnings, metal content, made in what country, warranty info, expirations, contact info, etc......as it pertains to the item sold), have all COC's necessary on file in your brand/company name, have GS1 registered UPC's in your business name on the product, even have MSDS's on hand in your company/brand name, just to start. Your own brand URL where customers can purchase your product line is always helpful but not necessary. In addition, it is always helpful to be able to show retailers around the country who carry your line of products. USTPO registered Trademark should not be pending, but the final determination document. When you were approved by your Liability Insurance Company, they asked for all of the same information prior to issuing the policy, so what Amazon asks for is no different.

2. "I've resolved it, registered my TM with a new filing firm and we're off to the races!

- You should have gone to the USTPO website, filled in the correct information, and submit the payment yourself. There was no need to pay any 3rd party to fill in the legal document for you and collect a fee. Amazon suggests using a 3rd party but cannot require it.

- Everything must match on every document submitted, name and address. Amazon seller account, retailer's license, Fed EIN, USTPO., Etc. If one of them is out of sync, it will always be rejected.

If your brand product really exists in the real world, your products will meet all US standards for packaging (child safety warnings, metal content, made in what country, warranty info, expirations, contact info, etc......as it pertains to the item sold), have all COC's necessary on file in your brand/company name, have GS1 registered UPC's in your business name on the product, even have MSDS's on hand in your company/brand name, just to start. Your own brand URL where customers can purchase your product line is always helpful but not necessary. In addition, it is always helpful to be able to show retailers around the country who carry your line of products. USTPO registered Trademark should not be pending, but the final determination document. When you were approved by your Liability Insurance Company, they asked for all of the same information prior to issuing the policy, so what Amazon asks for is no different.
