Helo Everyone, Can We issue a Letter Of Authorization to reseller of Pending Trademark Brand Registry?.

If you are the manufacturer and brand owner you can issue an LOA to anyone you choose.

That does NOT mean that Amazon has to accept it however.

Their house, their rules and Amazon would need to be able to have proof of brand ownership and chain of custody at some time.

If the TM is denied the LOA would be a liability for Amazon if they accepted it BEFORE the TM was 'live.'

Letters of Authorizations, the trick request by Amazon.

Did you notice that Amazon always asks for a manufacturer’s invoice first, then asks for/or a letter of authorization? Amazon knows how businesses are operated.

If you have a commercial retailers account with a manufacturer, your invoice as described above will suffice. You will not need a Letter of Authorization because the invoice says it all. If you really need one, your manufacturer Rep handling your account could get one for you.

If you do not actually have a commercial account with the manufacturer, Amazon knows companies will not give any letter of authorization to individuals without a commercial account.

Now with that said, are you the manufacturer of the product(s) in question? If so, Issue a letter. Just make sure it is notarized, to make it legal and not like it was self-made by a seller. Make sure it contains your legal business name and address as well as your EIN number, and the same for the company you are giving authorization to.

@Seller_CW0P5hgbsiqWXis mostly correct in his statement. The exception being licensed items (Disney, Star Wars, Minecraft, etc.) where the manufacturer has received permission to produce items.

In those cases you will need an LOA from both the manufacturer and a copy of the licensing agreement page showing the manufacturer is allowed to produce the specific item.

This is to keep grey market and counterfeit items in check, along with showing chain of custody should you sell outside of the manufacturers "zone of permission".
