Difficulty appealing an alleged policy violation

Hello all,

Happy Monday!

I've been having difficulty appealing an alleged policy violation which has unfortunately resulted in the temporary deactivation of my account. I sell healthcare products which includes over the counter medicines for people wanting to stop smoking/vaping, in this instance Nicorette chewing gum, which contains 2mg of nicotine.

These products are permittable for sale on Amazon as they are exempt from the Tobacco, E-Cigarettes and Related Products policy under the clause below:

Examples of Prohibited Listings Other nicotine-based products, unless approved by the Medicines and Healthcare Products Regulatory Agency (MHRA) as aids to smoking cessation.

All Nicorette products are approved by the MHRA as aids to smoking cessation and are therefore allowed on Amazon. In fact, Amazon sell the exact same product on another ASIN.

I have provided all the evidence to support this with photos of the packaging, links to the MHRA website and links to ASINS selling the same product. However, I keep receiving really poor responses such as the one shown attached below:

I have made 3 calls to Amazon Account Health "Specialists", who, after I spend 10 minutes of explaining their own policy to them, eventually agree with me that the products are allowed and ask me to resubmit my appeal. Unfortunately, the appeal gets reviewed by someone else who rejects it.

I cannot get my account re-activated because Amazon want to see my action plan of what I am going to do to "stop breaching the policy"!

It's like a circus. I feel like banging my head against a brick wall.

Please, does anyone have advice or experience in similar instances like this? Can I escalate my appeal to somebody who understands Amazon's policies?
