ASIN B0C1HGTZKG shows "OSNICA" as Listing Brand Name, but they have photos of a different Brand "ANCHOR" in Listing Images. So this ASIN creator is showing different Brand Names in Listing Brand and Listing Images. But Amazon does nothing about it.

Next, Brand Owner of OSNICA files Intellectual Property Complaint against our store for listing this same ASIN B0C1HGTZKG. Their UK Trademark Number is UK00003391587

Now let me show you the brilliance, i.e. Amazon.

UK00003391587 is a Trademark for Class 20 (Non-Metal Knobs) and Class 21 (Utensils).

The ASIN in question here B0C1HGTZKG is categorised on Amazon as a YARN. Trademark Class for Yarns is Class 23.

So the Trademark Number UK00003391587 (covers Class 20 & 21) does NOT even cover the ASIN B0C1HGTZKG (Class 23).

The ASIN B0C1HGTZKG has wrong images but nothing happens. It has wrong Brand Name but nothing happens. The Trademark does NOT even cover the Class of items in question here, but Amazon gives them Trademark protection instead of suspending their account for creating such deceitful listings.

The whole branding thing on Amazon has opened up a massive can of worms, and is a many tentacled monster that they will NEVER, EVER be able to resolve - all a problem of their own making.

The problem is, the ‘listing’ is branded with the sellers trademark and that’s why you got the violation.

I agree it’s ridiculous and Amazon really should make their bots check for trademark classes before dishing out violations, but amazons stance is that they don’t want to get involved in disputes between sellers so take the easy route.

I have never had any joy with this, however, you might find some success with reaching out to the managingdirector@amazon.co.uk email with all of the info to see if they will reverse the violation due to the trademark classes not matching or the brand. It matching but I wouldn’t bank on it.

I had a IP issues earlier this year for the product I was selling which was generic item that you will find everywhere in retail stores, someone went and registered the design and make a complained against us. I explained amazon in very detail and giving them all the evidence but they wont listen so I will say you are wasting your time, Amazon don't go by logic and common sense I wish you all the best trying explaining to amazon.

What I understand is "Osnica" is claiming and reporting misuse of their trademark, meaning their brand name is used incorrectly.

What a mess! I have people claiming to sell my brand when they aren't. Nothing you can do and You just drive yourself crazy trying.

I have had this argument with the bots at Amazon many times.

Only 2 of the IP complaints I have received have been from the actual brand, I have no issue with this and stop selling the item immediately.

I have, roughly, 5 that are from other sellers that have branded the listing with their company name. I have done my due diligence and these people are neither the manufacture or Brand owner. Very often the packaging will display another very well known brand name. When you explain this to Amazon, with pictures of the packaging, receipts to prove purchase they couldn't give a toss.

This is highly annoying as a seller because I want to make money, I want to run my business as efficiently as possible.

I highly doubt that what Amazon is allowing to happen is legal and it breeches their own policies.

Good luck finding an actual person that a, understands the issue and b, cares enough to do something about it.

Please remember though you are a valued seller and Amazon values working in partnership with you

So the trademark infringement violation against my account for the ASIN B0C1HGTZKG has been lifted, but on my 3rd try. HOW ?

If you look at the very first post here that explains the problem, you can see there are 3 main issues -

1 - ASIN itself is problematic with different names being shown in Listing Brand & Listing Images

2 - OSNICA as a brand is NOT registered as trademark for Yarns which is Class 23 product.

3 - ANCHOR the actual brand, the one visible in the listing images is manufactured by a different company. It is Not OSNICA.

First time I tried, I gave them ALL the information in complete detail, i.e. Issue 1, 2 and 3. They REJECTED.

Second time, I thought Amazon was getting overwhelmed with all this info I was providing, so I decided to concentrate on giving them only 2 of the 3 issues. They REJECTED.

Third time, I cut down my explanation even more, again wrote to them about 2 of the 3 Issues. Can't remember which 2 exactly. But I cut down on the number of sentences I was using. Just kept it short basically. They ACCEPTED.

Now, only Amazon can tell why they ACCEPTED my 3rd try with less details compared to my 1st try with full details.

OR Maybe one of the Amazon guys saw THIS thread and decided to do something about it.
