First, let me address this bad actor's message that what they are doing is in scope with Amazon rules... it is not. When you have the time and for any other sellers that come across this post, please review the Amazon Anti-Counterfeiting Policy.

Second, if you have not yet, report this seller via report abuse in the account health dashboard and use the "An abuse issue that is not addressed by the other topics on this menu."

As for reporting via Brand Registry, you have to align your submission with the infringement you are reporting or it will not be accepted. For example, if you are selecting Trademark: Product or packaging, you have to stick to the facts of how this product is violating TM on the product or packaging and avoid discussing how the product is counterfeit (since you cannot report counterfeit until your TM is fully registered with USPTO as @Seller_kIukTwdhvntAp (thank you) was getting at).

Please let me know once you have reported via report abuse and whatever case ID/compliant ID they provide (if any). I will do my best to track that as well as case ID 13179213051.
