How can Brand Registry be abused like this? 2+ year seller deactivated

Case ID: 16553017661

Amazon seller here for over 2 years with a AHR score of over 1,000 (max) and I was also enrolled in AHA (didn't help). I received a counterfeit with a test buy which is a critical violation. I realize Amazon takes claims of counterfeit very seriously, but I have never sold counterfeit products and never will.

I reached out to the brand and they ackowledged my supplier got the products from them, but they weren't supposed to sell to Amazon sellers due to price tanking which is understandable, I had seen other sellers selling on it so I thought it was ok for me to sell as well. I know stupid of me especially when the brand sold on the listing themselves.

I explained my situation and apolgized to them. They agreed to retract the complaint, I have been working with them for over a month now and for some reason they are unable to retract the complaint for whatever reason. The email I contacted them is the brand it has their brand name in the domain name, the email that I received the counterfeit claim is a gmail account, but anyone can make one of those I have tried emailing that, but have not even received any responses I do not believe that email gets monitored.

My next best option was to appeal to Amazon directly, I thought I could write a plan of action, but I have realized amazon wasn't accepting anything other then LOA. I have since received a LOA from my supplier to prove the products are authentic and my supplier was authorized from the brand, but all submissions I do into Account Health Dashboard instantly gets a denial after a few seconds. When I called Account Health Specialist for some reason they couldn't see any submissions I made either so they asked me to submit the information in case id: 16553017661

I realize my mistake in not formally checking if the brand allowed other amazon sellers to sell their brand, but it did not constitute them in reporting my products as counterfeit which has resulted in my entire store being taken down I had just wished they had asked me to either raise my prices due to my repricing bot competing with other sellers or stop selling altogether, but I was never given any warning. I know amazon doesn't require anything to prove counterfeit only an order id, I believe the brand reported my product in bad faith knowing that the products were authentic. I had also thought Amazon doesn't enforce MAP or distribution agreements, but the brand used Brand registry claiming my items were counterfeit to bypass this. I did review the case information associated to the information including the letter of authorization. The information indicates that the authorization letter is addressed from the brand to the supplier, but not to you. This will be the reason for the continued rejections as our team will be looking to see that you were authorized to sell on the platform.

As for the retraction, we would advise passing along this link for the brand to attempt to retract the complaint. Please know they will need the complaint ID associated which should have been provided in the initial notification you received.

As communicated to you, they will require a valid letter of authorization from the brand to you or a retraction from the rights owner. If they do not receive one of these options, we cannot guarantee a resolution will be available for this outcome.
