As a reminder, all producers of packaged goods on Amazon.de must be compliant with Extended Producer Responsibility (EPR) packaging requirements. This includes reporting your packaging volumes to the German packaging authority (ZSVR) on a regular basis, and at least once per year. Failing to do so will make you non-compliant, and Amazon will be legally obligated to suspend your listings for packaged goods.

Do I need to enter a system participation contract?

If your packaging is subject to system participation, you need to enter a system participation contract with one or more systems (PROs). According to the German law, packaging subject to system participation is defined as packaging that typically accumulates as waste with private final consumers. This includes packaging for retail, grouped items, services and shipments.

If your packaging is not subject to system participation, you do not need a system participation contract (though you may still need a registration). According to the German law, this includes transport packaging, reusable packaging, single-use beverage packaging subject to deposits, retail packaging for hazardous contents and retail grouped packaging that does not typically accumulate as waste with private final customers.

2.For other products sold by you, determine your packaging material and mass.

3.Declare your sales of packaged goods to ZSVR on the LUCID Portal, and to your chosen Producer Responsibility Organization (PRO).

4.Pay the requested fees to your PRO for the applicable reporting periods. These fees depend on the material and the quantity of packaging placed in Germany in a given calendar year.
