POA Help Appeal Design Infringment

Hey Everyone.

My account has been suspended. Spoke to seller support today and they informed its due to a design right infringement. I take full responsibility and was an oversight on my part that led to this error.

I have sent in a POA waiting for a response but thought if anyone on here could offer advice on the POA if you think its good or what I could improve on etc.

Dear Amazon Seller Performance Team,

I am writing in response to the suspension of my Amazon seller account due to a design infringement complaint. I would like to take this opportunity to address the issues that led to this suspension and provide greater detail on the steps I have taken to resolve the complaint, prevent future infringement, and ensure compliance with Amazon’s policies.

  1. Root Causes of the Infringement: I would like to provide more information on the root causes of the infringement. I understand that the infringement occurred due to a lack of understanding of Amazon’s policies regarding design infringement. I failed to thoroughly research and review the designs used in my product listings to ensure they did not infringe on the intellectual property rights of others. I understand that this was a mistake and I take full responsibility for this error.

  2. Actions Taken to Resolve the Complaint: To resolve the complaint, I immediately removed the infringing product listing from my inventory and Amazon’s platform. I also conducted a comprehensive review of all of my other product listings to identify any other potentially infringing designs or trademarks. Any listings that contained potentially infringing designs or trademarks were immediately removed. I have also reached out to the rights owner to apologize for any inconvenience caused and to confirm that the infringing product listing has been removed.

  3. Steps Taken to Prevent Infringement Going Forward: To prevent future infringements, I have taken the following steps:
    • Conducted a thorough review of all of my product listings to ensure that none of them contain any potentially infringing designs or trademarks.
    • Implemented a policy of only using original designs for my products.
    • Enrolled in Amazon’s Brand Registry to ensure that my brand is protected and to avoid any potential infringement issues.
    • Created an internal review process to regularly check my product listings for potential policy violations.

  4. How My Account has Complied with Amazon’s Policy: I understand that Amazon takes design infringement very seriously and I want to assure you that my account is now fully compliant with Amazon’s policies. I have thoroughly reviewed all of my product listings and removed any that contained potentially infringing designs or trademarks. I have also implemented an internal review process to ensure ongoing compliance. I am committed to maintaining compliance with Amazon’s policies going forward.

  5. Evidence of Compliance: To demonstrate my account’s compliance with Amazon’s policies, I would like to provide the following evidence:

• Evidence of Registered Trademark
• A copy of the internal review process that has been implemented to ensure ongoing compliance.

I hope that the information provided above demonstrates my commitment to resolving this issue and to ensuring that my account complies with Amazon’s policies. I would appreciate your consideration of my appeal and look forward to continuing to sell on the Amazon platform.

Thank you for your time and attention.

Hope someone can give me some advice if this is of a good standard and i stand a chance or what i could improve on if you think it will be rejected.

It is a good starting framework, but these things are always subjective to the reviewer.

As a guide, I would remove any details about your own brand registry and trademark, it has no bearing on infringing other’s IP rights and is not contributing to future prevention of infringement.

I would also rather reference the actual Amazon IP policies, review them and state you have reviewed them, see were the infringing listings broke policy and that all remaining listings have been reviewed in accordance with those policies which will also be used going forward.

Successful appeals typically have references tot he actual Amazon policy links demonstrating that you now understand the policies in order to not infringe later…
