Incorectly restricted prodcut due to FCC ID - Does not apply to our product

This listing was recently removed under the assumption that it might not comply with FCC regulations pertaining to radio frequency (RF) emissions. The product in question is a modern solution for sharing contact information via a QR code, enhancing the experience of social networking. It is equipped with a passive NFC chip that activates only in the presence of an NFC reader and is not designed for RF transmission. Only our most popular child ASIN was removed, the other colors are still active.

I have updated the title, description, and bullet points to make sure nothing is flagged in the system and provided supporting evidence from the FCC website. I just got back the same automated response:

  • We have received your request for review of the following product(s) and after careful consideration have determined that the product(s) does not meet the necessary criteria and will be restricted post the grace period because This product has been identified as a radio frequency (RF) device product that does not have an FCC ID entry in the fcc_radio_frequency_emission_compliance attribute. It seems like the evidence I submitted is not being reviewed by a human and my case is stuck until I add an FCC ID for my product.

As per FCC's regulations, an incidental radiator is a device that is not designed to intentionally emit RF energy. Our product's passive NFC component operates without an internal power source, and it only interacts with an NFC reader when in close proximity, without generating or emitting RF waves independently. I have updated the product field "Radio Frequency Emission & Authorization Status" to indicate that the product "is an incidental radiator as defined by the FCC. It is not designed to intentionally use, generate or emit RF energy over 9 kHz. It does not require FCC RF equipment authorization".

It clearly states that a passive tag is not subject to Certification because it does not contain batteries nor emit RF energy on its own on the FCC website in the evidence I have submitted. The product's passive NFC tag is only activated by an external reader and does not function as a source of RF energy, fitting the exact description provided by the FCC for devices that are not required to be authorized and are not subject to Certification because they do not contain batteries and do not authorize by themselves.

I am writing to seek advice for the next steps as I have already updated the listing to remove any details that could be triggering this and updated the Radio Frequency Emission Compliance to accurately describe that the product does not require an FCC ID in the optional field.
