Seeking Advice and Guidance on a Copyright Infringement Claim

Hello everyone,

I am an Amazon seller and I've recently encountered a challenging issue for which I'm hoping to get some advice and guidance.

We've been selling a product on Amazon for a month now, but recently we received a copyright infringement claim which resulted in our product being taken down. The reason given was "copyright on the product or product packaging". However, our product is packaged in generic brown paper boxes, so there's no issue of packaging infringement. We've also checked and this product doesn't have any patents. All our listing images and text are original, so I'm at a loss as to why we were successfully claimed for infringement.

We've contacted Amazon's account health team, but they've said they can't provide specific reasons for the infringement claim. This leaves us feeling very confused and anxious. Without knowing the specific reason for the infringement, we don't know how to address the issue.

If we admit to the infringement, which we believe we haven't committed, our product will no longer be sellable. If we submit a DMCA counter-claim, we're worried about potential unnoticed infringement points. If deemed DMCA fraud, it could greatly impact our sales.

Therefore, I'm hoping to get some help and advice here. How should we handle this issue? How can we find out the specific reason for the infringement? Is there a better way to resolve this?

Thank you very much for your help!

Hello @Seller_eIjEbWhC6sYtm

My name is Sandy from the Community Manager team.

Without context of what the product is I'm limited in being able to assist you, but I sure can help. Do you have any case IDs, complaint ID cases?

I created this post a few months ago that may help you appeal correctly if this is a false claim. Please check this here: How to respond to an Intellectual Property violation

This should help you understand and narrow down what the claim is about and how to properly appeal. If you claim this complaint is not true please provide those in the appeal and Amazon will investigate.

Best,

Sandy

I have the same problem. My money was only blocked as a result and I've been waiting for the answer from Amazon for 10 days, where the problem is. The account health manager just said he couldn't tell me what's going on with the account. What is this SCAM? Is that supposed to be serious business?
