How to report a Chinese seller selling a fake-branded product
We have a new competitor in our category who is selling a product branded with a famous company logo, and therefore taking away a lot of the sales. However, we know for a fact that they are just using this brand's logos on the packaging and product whereas it isn't actually produced by this brand.
We tried reporting it under seller abuse and our cases were automatically rejected, without even being reviewed by a human.
Can anyone advise how we go about reporting this correctly?
Thank you!!

Unfortunately, what you are trying to report is textbook IP infringement. The owner of the trademark of the brand you are talking about must be the one that reports the seller via, for example, brand registry. You can try contacting the brand and letting them know that there is an Amazon seller who is blatantly using their logo to sell products that are not in the catalog of that brand and, therefore, hurting the integrity of the brand. This is something that makes IP lawyers salivate when thinking of pursuing.
Reporting this under seller abuse would be unlikely to get accepted.

Good Afternoon @Seller_lOWDGmbepnrhb,
Sellers are responsible for complying with all laws, regulations, and Amazon policies when listing products. Amazon encourages sellers to report listing abuse or seller violations of Amazon's policies or applicable law.
All reports are thoroughly investigated by our team. For privacy reasons, the results of our investigations can't be disclosed, but we'll take any disciplinary actions we find appropriate.
Please report any abusive behavior using the Report Abuse tool on the Account Health Dashboard. Here is a video on how it works. If you are brand registered, you can also file a report through the Brand Registry report abuse tool.
Please let me know if you have any questions regarding the information provided above.
Sincerely, Cooper_Amazon

"We tried reporting it under seller abuse and our cases were automatically rejected, without even being reviewed by a human."
Well, that is because you are sending it to the wrong person.
Hopefully, you are a licensed business in your state and have a USTPO Brand Registry. Both of those have very powerful legal rights, which you seem not to be using. Try sending your legal documents along with a well-Crafted letter to Amazon's Legal Office in Seattle, by Certified Mail. They are the ones who understand your problem and can place a block on your branded listings in about a week.
Remember, you are no different that Sony or LG, you have the same rights in the USA to protect your business as they do. And.....You don't need a lawyer to write a letter.

The Report Abuse tooltools for "different product" don't work. They are simply broken. Most are rejected automatically and after many escalations I was offered to report through a case. There are many hidden rules that no one you can talk to knows. Dont ised the secod radio button. The "other" radio button may work best but if you report multiple orders it combines them, another cause for rejection.
I've had multiple cases with leadership team members about this. No one knows where to say what. Trying to report multiple sellers and patterns doesn't work.
I was told by one leadership team member if you don't get an email response then it is good. Not true. That same person filed a report with me while on a phone call. It was rejected. I was then told I couldn't report as a seller only as a customer. Some of the time Customer Service didn't report the violation and then it was a coin toss if anything would be done.
Sellers remained until they had multiple complaints.
Continued efforts to report resulted in bots deciding I had a "seller code if conduct" violation. Account Health said it was a false positive and removed it but I'm still getting emails it's not over!?
You have to find another way to report.
We had 41 counterfeit sellers over seven weeks on our top listings. Thousands lost in sales and 300-500 customers got counterfeit products.

order their product then report it as a customer.

WE'VE BEEN WHERE YOU ARE MANY TIMES - IT IS OUR OPINION THAT THE CHINESE HAVE TREMENDOUS LEVERAGE OVER AMAZON AND AMAZON ALLOWS THIS TO HAPPEN -

Nothing happens you just waste your time with Amazon because they only do something when their bots are triggered!
