Restocking fee for out of policy items

So I have a little issue where a customer ordered on november 24th, and somehow it approved a return on february 10th but they had to buy the label but it even shows "out of policy" on the order...it did come back but was used and their reason was "defective".

so the big question is...how much can i hold back for restocking fee or can they do a claim and it would be amazon funded? whats the best route on this one? it is higher value item...

Thanks for visiting the forums. Regarding the amount of restocking fee you may withhold, up to 100% in your case. However, yes, the buyer may come back with an A-to-z claim. The outcome of that action is unknown until it happens.

I would not call it a restocking fee as it was returned used and out of policy.

Its condition is materially different then when it was sold. Document its condition and if not actually defective document that also. This is to support your case should it come to an A TO Z but for now it is to support your withholding funds. NOTE date customer ordered and received item and when returned also.

Take pictures of the packing, the return label, product from all angles to show it has been used.

Those pictures will come in very handy.

You are not obligated to accept the return. Tell buyer to either 1) provide a label to return back to them or 2) you will donate item on their behalf.

Personally, I will change at least 100% restocking fees since it is out of policy and it was already used. Just be prepare to defend your self for A-Z Claims. Make sure that you already prepare the draft and include every important Facts and Pictures on your draft. You can post your draft here and hopefully, many fellow sellers will help you with your draft.
