Generic Brand getting violations

Alright i am very new to FBA, I have a product I listed under generic branding so I can list it and I have gotten hit with policy violations and tradmark issues. I need some direction as my products are not from a company that they are saying and I have provided an invoice from my suppliers.

Should I just pull the rest of my inventory off?

As all sellers are expected to follow local, state, and federal laws alongside applicable Amazon policies, whenever complaints of unauthorized intellectual property use or other circumstances surrounding intellectual property are reported they are complaints that must be taken seriously. Intellectual property is held within regard on Amazon due to the level of complexity involved.

If you had listed a generic item on a generic listing, there would not be a valid complaint to be made as, by definition, there is no brand attached to that listing. However, as you have stated there are issues with trademarks in your case, you should look over the listing to see what trademark is present, if there should be a trademark on the listing or not, and if you have the authorization to utilize that trademark. Generally, trademark law protects sellers of goods and services from customer confusion about who provides, endorses, or is affiliated with particular goods or services.

Did you check the listing for accuracy before you added an offer onto it? Did the listing show the brand was "generic?"

If you have not already looked over the listing or have not been provided the trademark in question, you will want to continue investigating on your own to identify that information. The United States Patent and Trademarks Office website is a great resource, alongside the World Intellectual Property Organization website.

All intellectual property must be correctly and lawfully used, which can include listing the trademark with the correct brand and listing with the proper authorization.

What is the specific violation as shown on your Account Health page? There are different requirements per type of violation, so providing this clarity here will help determine what you need to do or submit via the appeal button.

Trademark or Counterfeit infringement on the product or packaging violations are addressed by providing an invoice or Order ID that demonstrates the authenticity of the product. Invoices must meet certain requirements, as shown below:

  • Should reflect the sales volume of your product across all Amazon marketplaces in the last 365 days
  • Should demonstrate your product’s full supply chain
  • Should include contact information for the supplier(s) and the original manufacturer. We may contact suppliers or manufacturers to verify the documents
  • Your documents should be able to trace your products to the original manufacturer even if you did not purchase them directly from the original manufacturer. This may require requesting additional invoices or supply chain documentation from your supplier if you are not sourcing directly from the manufacturer.

You may remove pricing information, but the rest of the document must be visible to enable adequate review of the documents you provide. For ease of our review, you may highlight or circle the ASIN(s) under review.

For a trademark infringement on the product detail page, you will want to remove the trademark in the product detail page.
