Brand Registry - Auto Rejection, Appeal Rejected, and No Reason? No Phone #?

Hi,

I filed for Brand #1 a month ago. It got rejected because one of my listings was flagged for an issue and was deactivated. Took me weeks to fix that (lots of back and forth with Amazon, complete nightmare). Finally I got my listing fixed. The Brand #1 appeal case was technically still open.

So to just to be extra safe and save myself a headache, I bit the bullet, and spent another $300 with USPTO and made Brand #2, new UPC code, everything. Applied for Brand #2, and at the end of the form process, my application for my brand got auto-rejected. Super weird.

I suspect it is because Brand #1's case was "still open". Sigh. So I appealed for Brand #2, and got a generic response saying it could be for 1 of 6 reasons... All of the reasons are wildly different, and I have no idea on what the solution is.

This is a real brand, I have 600 units branded with it, ready to be sold. I need brand registry so I can access Vine. I'm unable to even get on the phone with the brand team, there only seems to be email support, which gives me generic responses.

How do I solve this?

Hello @Seller_ml0lSxI67mkWr,

My name is Dougal from the Community Manager Team and I would be happy to assist. First, no, there is no phone number for the Brand Registry enrollment team, but I was able to find your 2 applications and I can provide a bit more guidance/ reasoning why your applications were marked ineligible.

For both brands: The TM's are a mark drawing type that is not accepted to enroll a brand in Brand Registry at this time. Please reference the Enrollment guidelines for the US. Specifically, scroll down to the "Trademark type," section, this provides a chart with the accepted TM types as well as where to find them on your TM on the USPTO website.

One brand application typically does not affect the disposition of another. Both applications have been marked ineligible as you will find on your Brand Applications Dashboard on the Brand Registry site.

Also, if you wanted to push forward with brand #1, I recommend getting approval for the image and mark that you are using and having that on hand as I expect that will save you time with potential future issues.

Hope this helps, please let me know if you have any other questions.

Best, Dougal
