another seller selling my item

I have been selling an item on Amazon for over 6 years. Another seller started selling under my listing, so I bought one of his items. It is a completely different item. Not at all like the pictures that I have in my ad. It is an inferior item. I've tried to contact Amazon to no avail. I keep going in circles.

How can I speak with someone on the phone? I need to open a case. Any help would be greatly appreciated.

If you do not have a registered brand, you have no means of protecting the listing, or it's integrity.

Sure, there are technically cases you can open and bots you can talk to, but it wont get fixed. Happens every day, every hour, non stop, all the time. Amazon is too busy making money to worry about things that destroy other people's business....

Are you Brand Registered?

If not, here is the help page with instructions on how to → Report a Violation, but it hardly ever works.

The instructions say to provide 'Supporting Documentation,' but there is no field provided to upload any pictures or documentation of what you received (with a test-buy), so 99% of the time, you will just get an email saying no violation was found.

If you are Brand Registered, you will have a better chance of getting the seller removed.

When you say "My Listing", to ME you mean that YOU created the listing for a UNIQUE product with a UNIQUE UPC code that did not previously appear in the Amazon catalog.

When you say that "Another Seller started selling under my listing", you are strongly implying that YOU, and YOU ALONE have the Trademark or other form of Copyright protection on that particular UPC code, and that NO ONE ELSE may sell on "Your Listing".

IF the above IS the actual case, then you have recourse on Amazon:

I would first try contacting the other Seller directly via Amazon and request that they remove themselves from your listing, explaining how and why YOU have the sole right to sell this product on this listing.

You will probably receive no response, but it is possible that it is a simple error and not some grand effort to steal from you. Give the other Seller a chance to fix the problem first.

Then, IF they persist, you should have NO problem reporting them for Intellectual Property Violation, which WILL get their listing Blocked and put a Negative Mark on their Seller metrics.

IF, however, you do NOT "Own" the UPC code for this particular item, then the fact that YOU created the Amazon listing does NOT make it "Yours", and you have NO claim to sole ownership of the Resale rights.

If your actual issue is that the new Seller is NOT offering the EXACT SAME PRODUCT as is listed on the Amazon details page, that is yet another separate issue with a different solution.

You made a Test-Buy and you have photographic evidence to prove your position. You need to open a case using the "Report a Violation".

Additionally, you need to initiate a RETURN of the item CLEARLY indicating that it was the "Wrong Item Sent" AND make specific that it is a BOOTLEG and COUNTERFEIT product in the "Buyer Comment" section (if it actual IS such). These Key Words SHOULD trigger an immediate BLOCK on the other Sellers offer and force them to have to provide documentation to reinstate their listing.

Since this is the "Nuclear Bomb" of last resort, I once again implore you to FIRST try asking nicely for them to remove themselves from the listing. It is POSSIBLE that it is a simple human error and NOT malicious.

Don't listen to all the people saying there is nothing you can do.

Since you have done the test buy go to account health then report abuse. Pick out the one that applies. Fill out the form and then wait.

In the meantime do a return on the item and say it is not the exact product.

Amazon requires that someone listing on a product that product has to be exactly the same to include packaging. Exactly means exactly.

Now I have also gone and left negative feedback. Many will tell you not to. Once you have purchased a product, then in the eyes of Amazon you are a buyer and therefore have all the buyer rights. Now if you are lying about the vendor then you are being fraudulent and will get into trouble. And if you are trying to purposely discredit a buyer who has not broken any rules, then you can get into trouble.

Returning the product and leaving the negative feedback usually gets their attention.

Other sellers have given you good advice. On the item you purchased, make sure you leave them negative feedback stating the item did not match the one on the listing page and also make sure you do an A to Z claim for the item stating the seller sent you a completely different item. That will at least give him 2 strikes and maybe he will pull the listing.

but I got a hold of Amazon customer service (different from Seller services), and they sided with me that I received a different item than what was pictured. They gave me my money back. I also left seller feedback stating that the seller sent me something completely different than what was pictured.

You shouldn't have done this.

It seems that all these 6 years you sell on Amazon, you never came here in the forum to read all kind of questions and answers. Your fault. Selling on Amazon needs to stay up to date with all the changes and learning from other's faults.

What to do now? Take TWO days and study carefully the two answersf I mentionned in the beginning. Then you will know what to do. DO NOT wait any help from seller support.
